Terms of Service

These Terms of Service are a legal agreement between you and OurBets. By creating an account, joining a group, using the app, starting a trial, or purchasing a paid plan, you agree to these terms and to our Privacy Policy.

If you use OurBets for a group, team, organization, or other entity, you represent that you have authority to accept these terms for that group or entity.

OurBets is intended for users in the United States and other locations where the service may lawfully be used. You are responsible for following the laws that apply to you.

OurBets is not directed to children under 13. If you are under the age of majority where you live, you may use OurBets only with permission from a parent or legal guardian. You must be at least 18 years old, or the age of majority where you live, to purchase or administer a paid plan.

You are responsible for the activity that happens through your account and for keeping your login credentials secure. Tell us promptly if you believe your account has been compromised.

Group admins can invite members, manage settings, purchase paid plans, and remove users from their group. Group admins are responsible for how their groups use OurBets and for making sure group content follows these terms.

OurBets is a social prediction market app for private groups. Markets, odds, balances, leaderboards, points, virtual currency, and other in-app values are for entertainment, accountability, and social competition.

OurBets is not a sportsbook, casino, broker, financial exchange, or real-money gambling product. Virtual currency has no cash value, cannot be withdrawn, cannot be redeemed for money, goods, services, prizes, or anything of value from OurBets, and is not transferable outside the app.

You may not use OurBets to run illegal gambling, wagering, sweepstakes, lotteries, contests, financial trading, or any other regulated activity. You may not use OurBets to settle real-money bets between users.

Paid plans unlock group features such as higher limits, live updates, or other paid functionality described at checkout or in the app. Prices, features, taxes, and plan limits may change, but we will show the current terms before purchase.

Paid plans are billed through Stripe or another payment processor. By purchasing a paid plan, you authorize the payment processor to charge the payment method you provide for the selected plan, applicable taxes, and recurring renewal charges until the plan is canceled.

Subscriptions renew automatically unless canceled before the next billing period. You can manage or cancel a subscription through the billing portal in group settings or through any cancellation method we make available. Canceled subscriptions normally remain active until the end of the paid billing period.

Except where required by law, payments are non-refundable and we do not provide credits for partially used billing periods, downgrades, unused features, or inactive groups.

Do not use OurBets to violate the law, infringe rights, harass others, impersonate anyone, upload malicious code, interfere with the service, scrape the app, reverse engineer non-public parts of the service, or bypass billing, security, rate limits, access controls, or group permissions.

Do not create markets or content that promotes illegal activity, violence, self-harm, hate, sexual exploitation, doxxing, non-consensual intimate content, financial scams, or real-money wagering.

You keep ownership of the market questions, comments, names, avatars, and other content you submit. You grant OurBets a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify, and process that content as needed to operate, secure, improve, and provide the service.

You are responsible for the content you submit and for making sure you have the rights and permissions needed to submit it.

We may add, change, suspend, or remove features at any time. We may also suspend or terminate access if we believe a user or group has violated these terms, created legal risk, harmed the service, or used the app in a way that is unsafe for other users.

We try to keep OurBets available, but the service may be interrupted, delayed, limited, or unavailable because of maintenance, third-party providers, outages, security issues, or events outside our control.

OurBets is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that odds, balances, markets, notifications, charts, or payouts will be error-free, uninterrupted, or complete. OurBets is for entertainment and social use, not financial, legal, betting, investment, or professional advice.

To the fullest extent permitted by law, OurBets will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or unauthorized access.

To the fullest extent permitted by law, OurBets' total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid to OurBets for the service in the 12 months before the claim.

You agree to defend, indemnify, and hold OurBets harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of the service, your content, your violation of these terms, or your violation of law or third-party rights.

These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules.

Before filing a claim, you agree to contact us and try to resolve the dispute informally. You and OurBets agree that claims must be brought individually and not as part of a class action, consolidated action, or representative action, except where that waiver is prohibited by law.

We may update these terms from time to time. If we make material changes, we will provide notice by updating the date above, posting in the app, emailing account admins, or using another reasonable method. Continued use of OurBets after changes take effect means you accept the updated terms.
